  • Hazardous Waste & Superfund Matters

Government attorney or supervisor for many successful Region I Superfund cases including lead government counsel for the cornerstone case governing proposed Superfund settlements, US v. Cannons Engineering, 720 F. Supp. 1027 (D. Mass. 1989, aff'd, 899 F.2d 79 (1st Cir. 1990).

Represented clients in the Lower Fox River PCB site in Wisconsin, the Housatonic River PCB site in Massachusetts and Connecticut, the York Oil site in New York, the Beede Waste Oil site in New Hampshire, and numerous other state and federal hazardous substance remediation sites, including action sites under state and federal RCRA programs;

Represented clients in sediment sites with exposure potentials exceeding $500 million, Lower Fox River PCB site, Housatonic River PCB Site, Pine Street Barge Canal coal tar site, as member of nationally renowned multidisciplinary teams of technical and legal professionals;

Serve as coordinating counsel for PRP groups at two Superfund sites in New England;

Former deputy chief enforcement counsel of EPA national hazardous waste program.

  • Environmental Compliance & Permitting Activities

Represent clients in permitting, compliance, citizen suit and enforcement matters concerning federal and state hazardous substance liability and cleanup, surface water discharge regulation, wetlands protection, stormwater regulation, hazardous waste management and air quality regulation.

Comprehensive regulatory compliance planning for Yankee Rowe nuclear plant decommissioning and closure;

Recent compliance and enforcement projects: Manage compliance activities for inadvertently mixed sanitary and industrial wastewater; Defended federal stormwater discharge enforcement action; Defended local and state enforcement of wetlands Order of Conditions.

  • Representation of Citizens Groups

Represented watershed-based citizen group in challenge to municipal wastewater treatment plant NPDES permits, filed notices of federal and state Clean Water Act citizen suits;

Represent environmental resource conservation trust and neighboring property owners before town boards concerning permitting of proposed solid waste recycling facility.

  • Airport Environmental Cleanups

Represented clients in actions brought by operators of Logan Airport and Miami International Airport under state and federal laws against hundreds of airport-based businesses seeking cleanup of historical environmental contamination at airports;

Serve as expert witness concerning allocation of liability for cleanup of a municipal airport, formerly an air force base, in California.
